Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Refund Policy:
- "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Flaxxa, Inc., its subsidiaries and affiliates.
- "Service" refers to the Kartivo platform and all related services.
- "You" means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.
- "Subscription" refers to any paid plan or service purchased on a recurring basis.
Your Order Cancellation Rights
Given the nature of service provided by Flaxxa, Inc., its subsidiaries and affiliates, which includes digital services and platform access, we do not offer refunds on prepaid fees except when expressly communicated in writing by an authorized representative of the Company.
By subscribing to any of our plans, you acknowledge that you have reviewed the features and limitations of the chosen plan and agree to the terms outlined herein.
Cancellation of Monthly Subscription without Contracts
If you are on a monthly subscription plan without a binding contract, you may cancel your subscription at any time. Upon cancellation:
- Your subscription will remain active until the end of the current billing period.
- No further charges will be made after the current billing period ends.
- No refund will be issued for the remaining days of the current billing period.
- Your data will be retained for 30 days after cancellation, after which it may be permanently deleted.
Cancellation with Contracts
If you have entered into a contractual agreement with a minimum commitment period:
- Early termination fees may apply as outlined in your specific contract.
- Cancellation requests must be submitted in writing at least 30 days before the contract renewal date.
- No refund will be issued for the remaining term of the contract upon early cancellation.
Long-Term Subscription Cancellations
For annual or multi-year subscription plans:
- No partial refunds will be issued for unused months.
- You may downgrade to a lower plan at the end of your current billing cycle.
- Cancellation requests must be submitted before the renewal date to prevent automatic renewal charges.
Exceptional Cases for Refunds
Refunds may be considered in the following exceptional circumstances:
- 30-Day Service Failure: If we fail to provide the core services as described for a continuous period of 30 days or more due to issues on our end (excluding scheduled maintenance and force majeure events), you may request a prorated refund for the affected period.
- All refund requests under exceptional circumstances must be submitted in writing with supporting documentation.
- The Company reserves the right to evaluate each request on a case-by-case basis.
